Separation of Church and State

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

That is the first amendment of the US Constitution.

I understand the motivations from both sides of the separation between church and state issue, but the answer to the problem should be quite obvious.

Can congress pass a law requiring the 10 commandments be placed on all courtroom walls?
No.

Can a judge by choice, display the 10 commandments on the courtroom wall?
Absolutely, as far as the Constitution is concerned. The judge might have other rules to follow in regard to decorating his courtroom that might not allow for religious symbols, but it is NOT a Constitution issue.

If congress does not make a law pertaining to the issue, then the first amendment is not in play, according to the Constitution.
